 Report on judicial independence monitoring in Ukraine  / Centre for judicial studies 

 

On Dec 4, 2007 the Centre for Judicial Studies presented its Report on judicial independence monitoring in Ukraine, developed jointly with the All-Ukrainian Independent Judicial Association  and Foundation for the Support of Justice with the assistance of the Council of Judges of Ukraine, Ukrainian Association of Prosecutors and Union of Advocates of Ukraine

The presentation was attended by Vice-Chairmen of the Council of Judges of Ukraine and Judges of the Supreme Court of Ukraine O.F. Volkov (also Head of the Military Chamber of the Supreme Court of Ukraine), V.I Humenyuk and S.M. Mishchenko, Deputy Minister of Justice of Ukraine V.V. Lutkovska, members of the Ukrainian Association of prosecutors and of the Union of Advocates of Ukraine, judges, researchers, representatives of the legislative and executive authorities, journalists and delegates from non-governmental organizations.

Ambassador of Switzerland in Ukraine Georg Zubler attended and made a speech at the event.

An overall assessment of the entire set of applied indicators led to the following conclusion about the current status of judicial independence: “Ukraine is showing dangerous tendencies of interference with the independence of judges. At the same time the institutional independence of the judicial branch of power is permanently under the risk of destruction.”

The report on the monitoring of judicial independence was also presented to the delegates of the Congress of Judges of Ukraine held on Dec 7, 2007. It will be forwarded to the President of Ukraine, the Parliament and the Government. International organizations and the Ukrainian civil society will also get familiarized with the results of the monitoring endeavor.

The content of this publication reflects a monitoring exercise conducted in August – September in the framework of Ukrainian-Swiss Project “Support of Judicial Reform. Strengthening of Judicial Independence” to identify key issues with ensuring the constitutional principle of the independence of judges in Ukraine in 2008. The publication explains the monitoring methods, the system of assessment of judicial independence in accordance with the internationally accepted standards and the results of the monitoring accompanied by experts’ conclusions featuring comparisons with similar results for 2007. A reference to the Centre for Judicial Studies is obligatory for any use of information or other materials in this publication.
